Article 1 – Definitions
In these Terms & Conditions:
- Business: Woon Decoraties Ltd, trading as WoonDecoraties.
- Consumer: any natural person acting for purposes outside their trade, business, profession or self-employed activity.
- Agreement: the agreement between the Business and the Consumer concerning the purchase of Products through the Online Store.
- Product: any product offered for sale through the Online Store.
- Online Store: the WoonDecoraties online store available at https://woondecoraties.com.
- Right of Withdrawal: the Consumer's legal right to withdraw from an Agreement within the applicable withdrawal period without giving a reason.
- Withdrawal Period: the statutory period during which the Consumer may exercise the Right of Withdrawal.
Article 2 – Applicability
- These Terms & Conditions apply to every offer made by WoonDecoraties and to every Agreement concluded between WoonDecoraties and a Consumer through the Online Store.
- Before an Agreement is concluded, these Terms & Conditions will be made available to the Consumer in a way that allows the Consumer to store and reproduce them for future reference.
- If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Nothing in these Terms & Conditions is intended to limit any mandatory consumer rights granted under applicable law.
Article 3 – The Offer
- Products offered through the Online Store will be described as accurately and completely as reasonably possible.
- The main characteristics of each Product will be clearly stated in the product information.
- Prices displayed to Consumers will include VAT where legally applicable.
- Any additional costs, including delivery or shipping costs, will be clearly stated before the Consumer places an order.
- Obvious errors or mistakes in the offer, including obvious pricing errors, do not bind the Business.
- Product images are intended to provide an accurate representation of the Products. Minor differences in colour or appearance may occur due to screen settings, lighting or photography.
Article 4 – Formation of the Agreement
- The Agreement is concluded when the Consumer accepts the offer and fulfils the applicable conditions.
- After placing an order, the Consumer will receive an electronic order confirmation.
- The Business will provide the Consumer with the relevant order information on a durable medium, such as email.
- If an order cannot be accepted or fulfilled, the Business will inform the Consumer as soon as reasonably possible and will refund any amount already paid where applicable.
Article 5 – Prices and Payment
- The prices displayed during the checkout process are the prices payable by the Consumer, including VAT where applicable.
- Any applicable delivery or additional charges will be clearly displayed before the Consumer completes the purchase.
- Payment can be made using the payment methods made available during checkout.
- The Business reserves the right to cancel an order where there is an obvious pricing, technical or system error.
- If an order is cancelled because of such an error, any amount already paid for the cancelled order will be refunded.
Article 6 – Delivery
- The Business will exercise reasonable care when processing and fulfilling orders.
- Products will be delivered to the address provided by the Consumer during checkout.
- The Business will aim to deliver Products within the delivery period communicated during the ordering process.
- If delivery is delayed, the Consumer will be informed as soon as reasonably possible.
- Where a specific delivery deadline is legally essential and the Business fails to meet that deadline, the Consumer may have the right to terminate the Agreement in accordance with applicable law.
- Unless otherwise required by law, the risk of loss or damage to the Product passes to the Consumer when the Product is delivered to the Consumer or to a third party designated by the Consumer.
Article 7 – Right of Withdrawal
- For most online purchases, the Consumer has the legal right to withdraw from the Agreement within 14 days without giving a reason.
- The withdrawal period begins on the day after the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.
- Where an order consists of several Products delivered separately, the withdrawal period generally begins after the last Product has been received.
- The Consumer may exercise the Right of Withdrawal by sending a clear statement to the Business within the withdrawal period.
- The Consumer may use the model withdrawal form provided by the Business, but is not required to do so.
- Where available, the Consumer may also use the online cancellation or withdrawal facility provided on the Online Store.
Article 8 – Effects of Withdrawal
- If the Consumer withdraws from the Agreement, the Business will refund all payments received from the Consumer, including the cost of standard delivery where legally required.
- The refund will be made without undue delay and, in accordance with applicable law, no later than 14 days after the Business has been informed of the Consumer's decision to withdraw.
- The Business may delay the refund until the returned Product has been received or until the Consumer provides evidence that the Product has been sent back, whichever occurs first.
- Refunds will normally be made using the same payment method used for the original transaction, unless the Consumer expressly agrees otherwise.
- If the Consumer selected a more expensive delivery method than the least expensive standard delivery option offered by the Business, the Business is not required to refund the additional cost of the more expensive delivery method, where legally permitted.
Article 9 – Returns
- After exercising the Right of Withdrawal, the Consumer must return the Product without undue delay and, in any event, within 14 days after communicating the withdrawal to the Business.
- The Consumer is responsible for the direct cost of returning the Product unless the Business has agreed to bear those costs or the Consumer was not properly informed about the return costs before purchase.
- The Consumer must handle the Product and its packaging with reasonable care during the withdrawal period.
- The Consumer may be liable for any diminished value resulting from handling the Product beyond what is necessary to establish its nature, characteristics and functioning.
Article 10 – Exceptions to the Right of Withdrawal
The Right of Withdrawal does not apply where an applicable legal exception exists.
This may include, for example:
- Products made to the Consumer's specifications or clearly personalised for the Consumer;
- Products that are liable to deteriorate or expire rapidly;
- Sealed Products that are unsuitable for return for reasons of health protection or hygiene where the seal has been broken after delivery;
- Other Products or services for which a statutory exception to the Right of Withdrawal applies.
Where an exception applies, the Consumer will be informed before completing the purchase.
Article 11 – Legal Guarantee and Conformity
- Consumers are entitled to the legal guarantee and statutory conformity rights applicable to their purchase.
- Products must conform to the Agreement and must possess the qualities and characteristics that the Consumer may reasonably expect, taking into account the nature of the Product, information provided about the Product and other relevant circumstances.
- If a Product does not conform to the Agreement, the Consumer has the statutory rights and remedies provided by applicable law.
- Any commercial or manufacturer's warranty offered by the Business or a manufacturer does not affect the Consumer's statutory rights.
- Consumers may contact WoonDecoraties regarding a defective or non-conforming Product using the customer service details provided below.
Article 12 – Complaints
- Complaints concerning an order or Product can be submitted using:Email: info@woonsecoraties.com
- The Consumer should describe the complaint as clearly as possible and include the order number where relevant.
- The Business will review and handle complaints as soon as reasonably possible.
- The Business aims to provide a substantive response within a reasonable period.
- Submitting a complaint does not affect any statutory rights or remedies available to the Consumer.
Article 13 – Dispute Resolution
- WoonDecoraties encourages Consumers to contact the Business first so that complaints can be resolved directly whenever possible.
- If a complaint cannot be resolved satisfactorily, the Consumer retains all statutory rights to use an applicable alternative dispute resolution body, competent authority or court.
- Any applicable statutory or recognised consumer dispute-resolution procedure will not limit the Consumer's legal rights.
Article 14 – Personal Data
- WoonDecoraties processes personal data in accordance with applicable privacy and data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.
- Further information about how personal data is collected, used and protected is provided in the WoonDecoraties Privacy Policy.
- Personal data may be processed where necessary to process orders, payments, deliveries, customer service requests and legal obligations, or where another lawful basis for processing applies.
Article 15 – Intellectual Property
- All text, photographs, graphics, logos, designs, product descriptions and other content displayed on the Online Store are protected by applicable intellectual property laws where applicable.
- Unless permitted by law, such content may not be copied, reproduced, distributed or commercially used without prior written permission from the Business or the relevant rights holder.
Article 16 – Liability
- Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
- Nothing in these Terms & Conditions limits any mandatory statutory consumer rights.
- The Business will not be liable for losses caused by circumstances outside its reasonable control, to the extent permitted by applicable law.
- Nothing in this Article affects any liability that cannot legally be excluded or limited.
Article 17 – Force Majeure
- The Business will not be considered in breach of its obligations where performance is prevented or materially delayed by circumstances beyond its reasonable control.
- Such circumstances may include, where beyond the Business's reasonable control, serious transport disruptions, supply-chain disruptions, natural disasters, government measures, war, strikes, major technical failures or other comparable events.
- The Business will inform the Consumer as soon as reasonably possible where such circumstances materially affect an order.
- Nothing in this Article limits the Consumer's statutory rights.
Article 18 – Applicable Law
- The Agreement is governed by the law applicable under the mandatory rules of private international law and applicable consumer protection legislation.
- Where the Consumer is habitually resident in the Netherlands, nothing in these Terms & Conditions deprives the Consumer of the protection afforded by mandatory provisions of Dutch law that cannot be contractually excluded.
- Any choice of law shall not prevent the Consumer from relying on mandatory consumer protection provisions applicable to the Consumer's situation.
Article 19 – Changes to These Terms & Conditions
- WoonDecoraties may update these Terms & Conditions from time to time where there is a legitimate reason to do so.
- For existing Agreements, the version applicable at the time the Agreement was concluded will generally continue to apply unless a change is required by law or otherwise legally applicable.
- The most recent version of these Terms & Conditions will be published on the Online Store.
- The date of the latest update will be displayed at the beginning of these Terms & Conditions.
